SIGNIFICANT PROJECTS OVER THE YEARS OF 2023 – 2024 – 2025
- Company A in the real estate sector requests Company B to fulfill its bond obligations due to incomplete payment from a third party, with DIMAC assisting in negotiations and preparing for potential legal action if no settlement is reached.
- Company B in the medical field has failed to pay approximately VND 8 billion for 11 machines delivered under the Sales Contract and has not received the remaining goods; DIMAC is assisting Company A in negotiations before initiating arbitration proceedings.
- In 2017, Comapany A in the consumer goods sector has purchased an apartment from Ms A but cannot obtain the ownership certificate due to a lack of legal basis for foreign entities, so DIMAC is assisting in a lawsuit to invalidate the notarized sales contract and resolve legal issues.
- Company B in the engineering and plant technologies sector has not reimbursed over VND 2 billion to Company A in the construction and trading sector as agreed, after performing four system installation contracts for Ho Chi Minh City’s Metro Line 1, despite prior negotiations.
- Company A (the developer) and Company B (the contractor) entered into a contract for ID Fit-Out Works; after a dispute, DIMAC successfully assisted in arbitration, but Company B later petitioned to set aside the award, and DIMAC is representing Company A to protect its rights.
- A, the legal representative of Company A in the seafood processing industry, suffered damages due to Company B’s breach of obligations in the Share Pledge Agreement by illegally selling Mr. A’s shares. DIMAC represented Mr. A to protect his interests in court.
- Company A, operating in the investment and construction sector, filed a lawsuit against Company B for failing to fulfill its capital contribution obligation to a housing project in District 7 despite having received most of the benefits, and DIMAC was engaged to provide legal advice and handle the case in court amid changes in applicable laws over the long duration of the project.
- Company A, operating in the integrated technology retail sector, and Company B entered into a business transfer agreement in which part of the payment was to be made through real estate. However, Company B failed to fulfill its repurchase obligation as committed, making it difficult for Company A to recover its assets. DIMAC is assisting in the negotiation process and is prepared to represent the client in court if necessary.
- Company B in the financial sector and Ms. A signed a margin trading agreement, under which Company B provides margin services and requires Ms. A to provide additional collateral or sell securities when the margin ratio drops below 30%. When Ms. A failed to fulfill her obligations, Company B reclaimed the collateral to resolve the debt, but it was insufficient, leading to a lawsuit, with Ms. A counterclaiming a breach of contract. DIMAC advised on the strategy to request the Court to accept Company B’s claim and reject Ms. A counterclaim.
- Company B and Company D entered into a share purchase agreement, but the contract was declared invalid, leading Company D to request the return of the deposit. Company B sued Mr. A, and the case is currently in the reconciliation stage, with DIMAC assisting in finding the best strategy to protect the client.
