LABOR UTILIZATION REPORT IN 2025

The Ho Chi Minh City Department of Home Affairs has issued Notice No. 9002/SNV-VLATLĐ dated 13 November 2025, guiding enterprises, organizations, cooperatives, business households, and individuals employing workers in the city to submit the 2025 Labor Utilization Report in accordance with Form 01/PLI attached to Decree 145/2020/ND-CP.

Specifically, employers who fail to report on labor usage within the prescribed time limit will be fined from VND 5,000,000 to VND 10,000,000 according to the provisions of Article 8.2[2] of Decree 12/2022/ND-CP.

Accordingly, the deadline for submission is before 05 December 2025. Reports submitted after the deadline will not be accepted and may result in administrative penalties under Decree 12/2022/ND-CP.

The report may be submitted through one of the following two methods:

  • Via the National Public Service Portal at: https://dichvucong.gov.vn/, via the “Procedure for compulsory social insurance, health insurance, unemployment insurance adjustments and the labor utilization report”; or
  • Online submission to the Department of Home Affairs via Google Form: https://forms.gle/CiLKksGKq5McCyDP7(Note: The submission must include (i) a signed and sealed scanned copy (PDF); and (ii) an editable file (Excel).)

Article 8. Violations in recruitment and labor management

2. A fine of between VND 5,000,000 and VND 10,000,000 shall be imposed on employers committing one of the following acts:

a) Discrimination in labor, except for acts of discrimination specified in Point d, Clause 1, Article 13, Clause 2, Article 23, Clause 1, Article 36 and Clause 2, Article 37 of this Decree;

b) Using untrained labor or labor without a national vocational skill certificate for occupations or jobs that require trained labor or labor with a national vocational skill certificate;

c) Failure to report changes in labor as prescribed;

d) Failure to establish a labor management book or failure to establish a labor management book on time or failure to ensure basic contents as prescribed by law.
